Sheriff Michael S. Carona filed a
motion today asking a judge to throw
out secretly taped conversations
that helped federal prosecutors
build a public corruption case
against him.
According to the filing, investigators broke the law when they had former Assistant Sheriff Don Haidl use a body wire to record conversations with Carona on July 7, July 15 and Aug. 13. Such recordings are admissible as evidence in federal court only if the target of the investigation hasn’t retained an attorney — but Carona had had legal counsel for two years and prosecutors knew it, his attorneys argue. Assistant U.S. Attorney Ken Julian declined to comment. Carona, 52, was charged with conspiracy, mail fraud and witness tampering in October in a sweeping federal case that accuses him of pocketing nearly $700,000 in bribes and kickbacks. Two former assistant sheriffs — who were once Carona’s close friends — pleaded guilty to lesser charges in exchange for their cooperation, including the secret tapes. Carona, who is free on bail, has a June 10 trial date. He could face up to 105 years in prison if convicted on all charges.
